1. Introduction

Welcome to [Entrenched Essence] ("we," "us," or "our"). These Terms and Conditions ("Agreement") govern the rental and use of our salon suites and event venue located in Las Vegas, Nevada. By entering into a rental agreement with us, you ("Tenant" or "Client") agree to comply with and be bound by the terms outlined herein.

2. Rental Agreement

Salon Suites: Tenants shall enter into a separate lease agreement specifying the rental term, payment schedule, and suite-specific rules.

Event Venue: Clients shall enter into a separate event rental agreement detailing the event date, duration, fees, and venue-specific rules.

3.Head Spa Services

Head spa treatments provided by [Entrenched Essence] are cosmetic and wellness services intended for Hair and scalp care only. Services may include scalp cleansing, exfoliation, shampooing, conditioning, steam, aromatherapy, and gentle manipulation of the scalp, as necessary to perform the treatment.

No massage therapy services are provided. Treatments do not include body massage below the neck, including but not limited to the back, chest, abdomen, arms, hands, hips, legs, or feet. Any contact with the neck or shoulders is limited solely to what is incidental and necessary to perform the head spa treatment and is not intended as massage therapy.

Clients acknowledge that these services are not medical treatment, physical therapy, chiropractic care, or licensed massage therapy, and are not intended to diagnose, treat, cure, or prevent any medical condition.

Client Acknowledgment

By receiving services, the client confirms that they understand the nature and scope of the head spa treatment, have disclosed any relevant medical conditions, allergies, injuries, or sensitivities that may affect the service, and agree to notify the provider immediately if they experience discomfort or wish to discontinue any portion of the treatment.

Limitation of Liability

To the fullest extent permitted by Nevada law, the client voluntarily assumes the ordinary risks associated with receiving cosmetic head spa services and releases and holds harmless [Entrenched Essence], its owners, employees, and independent contractors from claims arising from ordinary negligence related to the services provided, except where liability cannot be waived under applicable law, including claims involving gross negligence, reckless conduct, or intentional misconduct.

4.Payment Terms

Deposits: A non-refundable deposit of [50%] is required to secure the booking/reservation.

Balance Due:[ Hair Services] The remaining balance is due once service is completed via invoice or cash only. Cash app, Venmo, etc. not accepted

Balance Due: [Venue and Salon Space] The remaining balance is due [1] days before the rental date if it's the venue. And the following weekly suite rent will be due by Sunday 11:59 PST every week.

Late Payments:[Venue and Salon Space] Late payments may incur a 5% fee of [total base lease amount].

4. Cancellations and Refunds

Hair Care Services: 50% deposit will be forefeited upon no-call/no-show or cancellation within 23 hours of scheduled appointment. Reschedule courtesy is based upon stylist(s) discretion.

Salon Suites/Booths: Tenants must provide [30] days' written notice for lease termination. Failure to do so may result in forfeiture of the security deposit and ability to lease with Entrenched Essence in the future.

Event Venue: Cancellations made:

More than 30-60 days before the event: Full refund minus a $250 administrative fee.

14-29 days before the event: 50% of the total rental fee forfeited.

Less than 14 days before the event: 100% of the total rental fee forfeited.

5. Use of Premises

Compliance: All activities must comply with local, state, and federal laws, including health and safety regulations.

Occupancy Limits: Clients must adhere to the maximum occupancy limits as specified in the rental agreement.

Prohibited Activities: Illegal activities, smoking, and unauthorized alterations to the premises are prohibited. You will be fined accordingly.

6. Maintenance and Repairs

Salon Suites: Tenants are responsible for maintaining cleanliness and reporting any maintenance issues promptly.

Event Venue: Clients are responsible for returning the venue to its original condition. Additional cleaning fees may apply for excessive mess or the forfeiture of all or some of your refundable deposit.

7. Insurance Requirements

Salon Suites: Tenants are required to carry professional liability insurance and provide proof upon request. If tenant doesn't obtain it, they assume all charges, damages, and penalties alone and agrees that Entrenched Essence isn't at fault.

Event Venue: Clients must obtain event liability insurance naming [Entrenched ESs] as an additional insured and submit proof at least three days prior to the event. If client doesn't obtain it, they agree to assume all responsibility and cost of damages and inconvieniencies.

8. Indemnification

Clients agree to indemnify and hold harmless [Entrenched Essence], its owners, and employees from any claims, damages, or expenses arising from the use of the premises, except in cases of gross negligence or willful misconduct by [Entrenched Essence].

9. Termination

We reserve the right to terminate any rental agreement immediately if the client violates any terms of this Agreement or engages in illegal or disruptive behavior. No refunds will be issued in such cases.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Nevada. Any disputes arising under this Agreement shall be resolved in the courts located in Clark County, Nevada.

11. Amendments

Any amendments to this Agreement must be made in writing and signed by both parties, with a witness present.

12. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, agreements, or understandings of any kind.

Acknowledgment

By checking the checkbox, the parties acknowledge that they have read, understood, and agreed to the terms and conditions set forth in this Agreement.
